It is important to note that under LMIA (programs), the federal government of Canada allows authentic employers to hire foreign skilled workers, professionals, trained youth and so on. What is Labour Market Impact Assessment (LMIA)?

The Labour Market Impact Assessment is a legal document issued to Canadian employers, who seek to hire a foreign national or skilled worker to meet requirements of local labour markets in provinces and territories as well as to fill vacant job positions in diverse industries and sectors. The LMIA program is always supported by valid job offers. The Employment and Social Development Canada (ESDC) permits Canadian employers to hire foreign skilled worker provided they advertise the vacant positions in various platforms, job portals, newspapers, magazines, employment platforms etc for one month. If Canadian employers still do not find Canadian citizen or permanent resident willing or fit for the job positions, they are allowed by ESDC to hire a foreign worker.

It is important to note that Canadian employers should be a regular taxpayer in Canada. Also, the occupation or job position offered by Canadian employer or selected by candidate (or foreign skilled worker) should be listed in the National Occupation Classification (NOC) list. The NOC is the national system to describe and grouping (classifying) job vacancies or positions according to skills.

In order to secure Canada work permit, both Canadian employers and foreign skilled workers and immigrants need to have a copy of positive LMIA to support job offers and expedite visa application process. In other words, a valid job offer should always be supported by a positive LMIA.

Temporary Foreign Worker Program

Temporary Foreign Worker Program (TFWP) is divided into streams for higher-skilled workers and lower-skilled workers. Positions mentioned in skill levels 0, A and B of National Occupational Classification (NOC) system are grouped in higher-skilled category, while job positions mentioned in skills levels C and D are grouped in lower-skilled category.

In order to oversee demands of local labour markets and permit foreign skilled workers to enter the country, the Employment and Social Development Canada (ESDC) has designed LMIA Canada immigration process.

To summarise, the ESDC considers below-mentioned aspects in a valid job offer (issued by Canadian employers) –

  • Salary offered to foreign skilled workers and immigrants should be in sync with average salary paid for occupation or job position
  • The work conditions must follow existing laws for employees
  • The hiring of skilled workers must fulfil shortage of labour in specific province or territory
  • Canadian employer must obtain LMIA from ESDC
  • Through positive LMIA it must be highlighted that foreign skilled worker or immigrant must contribute to economy and growth
  • The valid Canada job offer letter must mention all related features of job positions or occupation

Different Categories of Canada Work Permit

The Work Permit can be easily secured by candidates, who fall into the following categories –

  • Temporary workers – Based on the education, skills, training, knowledge, experience and nature of work done by the candidate, Canadian employers offer job (employment) offers supported by LMIA or in other terms help candidates secure Canada Open Work Permits and Employer-specific Work Permits. Such foreign skilled workers are allowed to extend Canada work permit after fulfilling eligibility criteria.
    Open Work Permit– Candidates are allowed to work for any Canadian employer in specific province. Canadian employers, who do not fulfill government’s regulations, do not come in this category. The Open Work Permit is only granted to candidates, who fulfill all eligibility criteria.
    Employer-specific Work Permit –Candidates having required education, skills, training, work experience and language proficiency are allowed to secure employer-specific work permit.
  • Permanent workers – Candidates under this category of work permit are allowed to work and stay in Canada. They need to create online profile in Express Entry pool.

Duration of Work Permit
For majority of job positions and occupations, the duration of Canada work permits is time bound. The specific duration is also mentioned in documents.

How Candidates Can Secure LMIA Canada Immigration?

Foreign skilled workers, professionals, trained youth and immigrants can secure LMIA after receiving valid job offer from Canadian employer. The job positions must be highlighted in NOC. It is important to note that only eligible candidates can file visa application through online or offline mode along with required set of documents, including job reference letter and work experience certificates from previous employers during last ten years.

Documents Required For Securing Work Permit

Candidates must submit below-mentioned set of documents in ready to use format to the authorities for processing of work permit for Canada:

  • Passport with at least one clear page, other than the last page.
  • A valid job (employment) offer from Canadian employer
  • Copy of positive LMIA mentioning nature of work, location and timings of work assignments, wages, salary, duration of work assignment, designation etc.
  • Personal documents such as age proof (birth certificate) of candidate
  • IELTS score card (language proficiency)
  • Work experience certificate from previous employer during last ten years
  • Enough funds
  • Medical certificate (if applicable)
  • Clean records of candidate (if applicable)

Application Fee for LMIA

In order to hire skilled foreign workers, young professionals, immigrants and trained youth, Canadian employers have to meet certain processing demands like advertising job vacancies in local media and publications. Such actions require processing fee, which need to be paid by Canadian employers. The interested applicants also need to pay application fee for LMIA according to current laws and rules.

Canadian employers must pay a fee of $1,000 (or CAD) in order to submit a LMIA application under the Temporary Foreign Worker Program.

How Long Does it Take to Receive LMIA?

The processing of applications depends on documents of applicants. Generally, processing takes from a couple of weeks to a few months. Both Canadian employers and skilled workers (applicants) must note that processing also includes advertising the vacancy for four weeks in local dailies, employment platforms and so on.
